§ 18-89. Regulation of the sale, purchase and distribution of alcoholic beverages by and to persons under twenty-one (21) years of age.

  • (a)

    No person knowingly, directly, or through another person, shall furnish, cause to be furnished, or permit any person in such person's employ to furnish any alcoholic beverages to any person under twenty-one (21) years of age.

    (b)

    No person under twenty-one (21) years of age shall purchase, or knowingly possess, any alcoholic beverage.

    (c)

    No person under twenty-one (21) years of age shall misrepresent such person's age in any manner whatever for the purpose of obtaining illegally any alcoholic beverage.

    (d)

    No person knowingly or intentionally shall act as an agent to purchase or acquire any alcoholic beverage for, or on behalf, of a person under twenty-one (21) years of age.

    (e)

    No person under twenty-one (21) years of age shall misrepresent his identity or use any false identification for the purpose of purchasing or obtaining any alcoholic beverage.

    (f)

    The exceptions contained in O.C.G.A. § 3-3-23(b), (c) and (d) of the laws of the State of Georgia are hereby incorporated by reference, and shall serve as exemptions for any person charged under subsections (a) through (e) of this section.

    (g)

    (1)

    No person shall allow or require a person in his employment under eighteen (18) years of age to dispense, serve, sell, or take orders for any alcoholic beverages for consumption on the premises.

    (2)

    This subsection shall not prohibit persons over eighteen (18) years of age who are employed in supermarkets, convenience stores, breweries, or drug stores, from selling or handling alcoholic beverages which are sold for consumption off the premises.

    (h)

    Penalties. Any person convicted of violating any prohibition contained in subsections (a), (c), (d) and (e) of this section shall be guilty of a misdemeanor.

    (i)

    Nothing in this section shall repeal or affect any provision of chapter 4 of the Code of Ordinances, City of Fitzgerald, Georgia.
